Probate
Probate is the court-supervised procedure for transferring assets and paying debts upon a loved one’s death pursuant to their Will, or, if your loved one did not have a Will, than according to intestacy laws.
A probate proceeding includes the following: appointing a personal representative for the decedent’s estate; identifying the decedent’s heirs; collecting the decedent’s assets and selling such assets when appropriate; paying taxes, debts, and claims against the estate; completing the decedent’s final tax returns as well as the estate’s tax returns; and distributing the remaining assets to the decedent’s beneficiaries or heirs.
