LGBTQ+ FAMILY LAW

After the marriage equality cases of Wolf v. Walker and Obergefell vs. Hodges, same-sex and all LGBTQ+ couples in Wisconsin who are ending their relationship now have the same rights and responsibilities under Wisconsin’s divorce law, marital property regime, and parentage laws.

Wisconsin LGBTQ+ Lawyers

Our firm has a strong history of fighting and advocating for LGBTQ+ families and their children in Wisconsin, at the trial and appellate court levels. We have been doing it for over 20 years.

Sara Vanden Brook leads this practice area for The Law Center, as an experienced divorce attorney recognized by Super Lawyers as a Rising Star.

Another attorney, Emily Dudak Leiter, was the lead attorney in a 2014 appeal in Wisconsin about applying the marital presumption of parentage to married same-sex couples post-marriage equality. She also co-authored the LGBTQ+ family formation and protection chapter of the Wisconsin State Bar book entitled “Advising the Evolving Family,” formerly “Sexual Orientation and the Law.” Emily consults on The Law Center cases when issues of parentage are involved.

For more detail about the marriage equality cases, parentage and adoption issues, and the full range of protections we provide to LGBTQ+ families, please see our webpage on LGBTQ+ Family Formation and Protection.
